Privacy Policy

1.1 Data Controller

FluxPixelStudio, registered at Beco Sá Carneiro, Lote 4, 8200-262 Albufeira, Portugal, is the data controller responsible for the processing of personal data collected through this website and our design services.

1.2 Data We Collect

We collect personal data that you voluntarily provide when contacting us, requesting a quote, or engaging our UI/UX design services. This includes: name, email address, phone number, company name, project brief details, and billing information necessary to execute our contractual obligations.

1.3 Purpose of Processing

Personal data is processed solely for: (a) responding to inquiries and providing design service proposals; (b) executing agreed-upon design projects; (c) billing and payment processing; (d) legal compliance under EU regulations; and (e) improving our service delivery based on aggregated, anonymized data.

1.4 Legal Basis

Processing is based on: (a) performance of a contract (Art. 6(1)(b) GDPR) when you engage our services; (b) your explicit consent (Art. 6(1)(a) GDPR) for marketing communications; and (c) legitimate interest (Art. 6(1)(f) GDPR) for improving service quality and security.

1.5 Data Retention

Personal data is retained for the duration of the service relationship plus 24 months for warranty and legal compliance purposes. Project files and design assets are retained for 12 months after project completion unless otherwise agreed. You may request earlier deletion at any time.

1.6 Your Rights

Under GDPR, you have the right to: access your personal data, rectify inaccurate data, request erasure ("right to be forgotten"), restrict processing, data portability, object to processing, and withdraw consent at any time. To exercise these rights, contact [email protected].

1.7 Data Sharing

We do not sell, rent, or trade personal data. Data may be shared with: (a) payment processors for transaction completion; (b) hosting providers for website operation; (c) analytics tools (only anonymized data); and (d) law enforcement when legally required. All third-party processors are bound by Data Processing Agreements (DPAs) ensuring GDPR compliance.

1.8 International Transfers

If personal data is transferred outside the EEA, we ensure adequate protection through Standard Contractual Clauses (SCCs) or adequacy decisions as required by GDPR Chapter V.

Terms of Service

2.1 Scope of Services

FluxPixelStudio provides bespoke UI/UX design services including but not limited to: interface design, prototyping, design systems, landing page design, dashboard design, mobile app UI, e-commerce UI, UX audits, and SaaS product design. Each engagement is governed by a specific project agreement defining scope, deliverables, timelines, and pricing.

2.2 Quotations & Agreements

All quotations are valid for 30 days from the date of issue. A project commences only upon written acceptance of the quotation and receipt of the initial payment as specified in the project agreement. FluxPixelStudio reserves the right to adjust pricing for scope changes beyond the original agreement.

2.3 Payment Terms

Payments follow the milestone schedule defined in each project agreement. Standard terms: 40% upfront upon agreement, 30% at midpoint milestone, 30% upon final delivery. Late payments incur a 2% monthly surcharge. All prices are in EUR and inclusive of applicable taxes unless otherwise stated.

2.4 Intellectual Property

Upon full payment, all design deliverables (Figma files, assets, prototypes) transfer to the client. FluxPixelStudio retains the right to showcase work in portfolios and case studies unless the client requests confidentiality in writing. Pre-existing design systems, templates, and tools remain the property of FluxPixelStudio.

2.5 Revisions & Changes

Each project tier includes a defined number of revision rounds. Additional revisions beyond the agreed scope are billed at €85/hour. Scope changes requested after project kickoff require a written change order with updated timeline and cost estimate.

2.6 Project Timeline & Delays

Delivery timelines are estimates based on the project scope at agreement. Client-caused delays (delayed feedback, missing materials) may extend the timeline proportionally. FluxPixelStudio commits to transparent communication regarding any delays on our end.

2.7 Limitation of Liability

FluxPixelStudio's total liability under any project agreement shall not exceed the total fees paid under that agreement. We are not liable for indirect, incidental, or consequential damages, including lost profits or business interruption.

2.8 Confidentiality

Both parties agree to maintain confidentiality of proprietary information shared during the engagement. This obligation survives the termination of the agreement for a period of 24 months.

2.9 Termination

Either party may terminate a project agreement with 14 days' written notice. Upon termination, the client is invoiced for all work completed to date. Prepaid amounts for unstarted phases are refunded in full.

2.10 Governing Law

These terms are governed by the laws of Portugal. Disputes shall be submitted to the exclusive jurisdiction of the courts of Faro, Portugal.

Refund & Reimbursement Policy

4.1 Refund Eligibility

FluxPixelStudio offers refunds in accordance with EU consumer protection laws and the following policy. Refund eligibility depends on the stage of the project and the nature of the service delivered.

4.2 Pre-Project Cancellation

If you cancel a project before any design work has commenced (within 14 days of agreement), you are entitled to a full refund of any advance payments. Cancellations after work has begun are subject to the milestone-based refund terms below.

4.3 Milestone-Based Refunds

For projects with milestone payments: (a) unstarted phases are fully refundable; (b) in-progress phases may be refunded proportionally based on work completed; (c) completed and delivered phases are non-refundable. FluxPixelStudio will provide a detailed breakdown of work completed upon refund request.

4.4 Deliverable Quality

If delivered design work does not match the specifications outlined in the project agreement, FluxPixelStudio will revise the deliverables at no additional cost. If revisions cannot resolve the discrepancy, a partial or full refund may be issued at FluxPixelStudio's discretion, proportional to the deviation from agreed specifications.

4.5 Refund Process

To request a refund, contact [email protected] with your project reference number and reason for the request. Refund requests are processed within 10 business days. Approved refunds are returned via the original payment method.

4.6 Non-Refundable Items

The following are non-refundable: (a) work that has been approved and delivered by the client; (b) additional revision rounds beyond the agreed scope that have been executed; (c) third-party costs incurred on behalf of the client (stock assets, fonts, hosting) that have already been paid.

4.7 Dispute Resolution

Refund disputes shall be resolved through direct communication between the parties. If no resolution is reached within 30 days, either party may initiate proceedings under the governing law of Portugal. FluxPixelStudio is committed to fair and transparent resolution of all refund requests.
